1. Definitions
- "Agreement" means these Terms & Conditions and any programme confirmation provided to the Client.
- "Mawar" or "we" or "us" refers to Mawar, operating from No. 73, Jalan Bukit Bintang, 55100 Kuala Lumpur, Wilayah Persekutuan, Malaysia.
- "Client" or "you" refers to the individual or family who engages Mawar's services.
- "Programme Recipient" refers to the older adult for whom the programme is arranged.
- "Programme" refers to any of Mawar's three service offerings: Social Engagement, Regular Check-in & Family Updates, or Daily Living Support Coordination.
- "Website" refers to the Mawar website at mawarx.pro.
2. Acceptance of Terms
By using this website or engaging any Mawar programme, you confirm that you are at least 18 years old and have the legal capacity to enter into this Agreement. Engagement of a programme by email confirmation, verbal agreement, or payment constitutes acceptance of these terms in full.
3. Service Description
Mawar provides structured companionship, household coordination, and family communication programmes for older adults in the Klang Valley, Malaysia. Our services are arranged as general companionship, household assistance, errand coordination, social activities, and family information coordination. No professional medical, clinical, financial, or legal advisory service is provided or implied.
Programmes are available subject to capacity and geographic scope. Mawar reserves the right to decline or discontinue a programme where delivery is not practicable.
4. Programme Commencement & Scope
Each programme begins on a confirmed start date agreed between Mawar and the Client. The scope, schedule, and deliverables are outlined in the programme confirmation communicated to the Client. Changes to scope are subject to mutual agreement in writing.
Mawar will make reasonable efforts to assign a consistent companion or coordinator. Where substitution is unavoidable, Mawar will notify the Client in advance where possible.
5. Client Responsibilities
- Provide accurate information about the Programme Recipient's preferences, needs, and household circumstances
- Ensure that the Programme Recipient is willing to participate in the arranged activities or visits
- Designate and maintain a reachable family contact for programme communication
- Settle invoices within the stated payment terms
- Give reasonable notice of any changes to schedule, address, or programme requirements
6. Payment Terms
Programmes are billed monthly in Malaysian Ringgit (RM). Invoices are issued at the start of each month and are payable within 10 working days via DuitNow or direct bank transfer. Mawar reserves the right to pause programme delivery if payment is more than 14 days overdue. Pricing is as stated at the time of programme confirmation; Mawar will give at least 30 days' notice of any price change.
7. Cancellation & Modification
Either party may cancel a programme by providing 14 days' written notice. Programmes may be paused or modified by mutual agreement. Fees already paid for the current billing month are non-refundable unless Mawar is unable to deliver the programme through its own fault.
8. Intellectual Property
All written materials, programme frameworks, activity calendars, and update templates produced by Mawar remain the intellectual property of Mawar. Clients may use materials shared with them for personal family purposes but may not reproduce or distribute them commercially.
9. Disclaimers
Mawar provides companionship, coordination, and information services only. We are not a licensed healthcare provider, social worker, or financial adviser. Nothing in our programmes constitutes a regulated professional service. Families should seek qualified professional advice for medical, financial, or legal matters relating to the Programme Recipient.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Mawar's aggregate liability to a Client for any claim arising out of or related to these Terms or a programme shall not exceed the total fees paid by the Client in the three months preceding the claim. Mawar is not liable for indirect, consequential, or special damages.
11. Indemnification
The Client agrees to indemnify Mawar against any claims, losses, or liabilities arising from false or misleading information provided by the Client, or from the Client's failure to comply with these Terms.
12. Governing Law & Dispute Resolution
This Agreement is governed by the laws of Malaysia. Any disputes shall be resolved first by good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be referred to the courts of Kuala Lumpur, Malaysia, which shall have exclusive jurisdiction.
13. Changes to These Terms
Mawar may update these Terms from time to time. The updated version will be posted on our website with a revised "Last Updated" date. Active programme Clients will be notified by email of material changes at least 14 days before they take effect. Continued engagement with Mawar's services after the effective date constitutes acceptance.
